Terms and Conditions
These Terms and Conditions apply to all users access to and or registered at CS Online Platform at www.mycs.com.my (“CS Online”). CS reserves the right to amend, revise, vary, replace and or update this Terms and Conditions at its sole discretion without any notice to you or any other users of CS Online.
Your access to, and use of the materials contained at the CS Online is conditional on your acceptance and compliance with the terms, conditions, notices and disclaimers contained herein or elsewhere at the CS Online, including the terms and conditions that may be updated from time to time (“Terms and Conditions”). By using CS Online, you agree to be bound by these Terms and Conditions.
You must ensure that details provided by you on registration or at any time are accurate and complete. You shall inform CS immediately of any changes to the information that you provided upon registration by updating your personal details.
Registration for Business Customer
You must ensure that details provided by you on registration or at any time are accurate and complete. By registering with CS Online, you covenant, warrant and represent that you shall have legal capacity and with proper authorization from the company in such registration. You must inform CS immediately of any changes to the information that you provided upon registration by updating your company details.
After the registration approved by CS, a temporary password will be given to Business Customer through email. This temporary password must be kept confidential and must not be disclosed or shared with anyone. You must ensure to reset the password upon log in to your Account with the temporary password within the time limit.
Orders made through a business account shall be delivered strictly to a company address as registered at CS Online. Any business orders placed for delivery to either a non-registered company address or a residential address will not be processed.
Rights to suspend or cancel registration
CS reserves the right to suspend or cancel your registration immediately at CS sole discretion without assigning any reason whatsoever.
Pricing and Product Information
CS reserves the right to revise the price and other details of the products without notice. Fresh products (example: vegetables, fruits, poultry, seafood and etc.) may different from photo as these natural products can never be identical. CS reserves the right to provide the nearest size/packaging for the fresh products.
The prices displayed at CS Online are for CS Online Store only and these prices will not be the same with any of CS physical store or other access online platform.
When the products are sold by weight, CS reserve the right to supply the product with a weight difference. However, CS shall make every effort to ensure the weight difference is minimal and as close to the order made.
The product image is for display purpose only. The actual product may be different from the product image due to the change of product packaging from supplier which CS may only notice when the stocks arrive. However, CS will ensure the content of the product remain the same and only packaging is different.
In situation of stock unavailability for any item in an order placed with CS, CS reserves the right to process the order without the out of stock item without informing you. However, if the item can be substituted with other similar product, CS shall contact you to confirm the substitute product. The substitute product may have different price, which the differences of the price (irrespective lower or higher) shall not be deduct/add to your bill. Should there be an event where you do not respond to CS’s contact for this confirmation or you reject the substitute product offered by CS, CS shall proceed the order without the substitute product by removing the unavailable product, and refund will be made accordingly on the price of the unavailable product.
Delivery will be made to the address given by you upon order made. CS does not deliver to P.O. Box address, any address does not cover in CS delivery area or any international address. Any inaccuracies and/or discrepancies in the delivery address may result in your order being cancelled.
All orders will be delivered to the main entrance of the delivery address.
In the event where CS has been requested to leave the order on your doorstep, CS shall not be liable for any consequential, indirect or special damage or loss of the order.
Standard delivery and On-demand delivery are available in selected areas only.
On-demand delivery will be agreed by you at the time of placing the order and booking the delivery slot.
All paid orders will be processed accordingly within working hours. Our logistic partner will have their best effort to collect all orders and deliver to you. For standard delivery, orders placed on Friday after 12pm and over the weekend, will be processed on the following Monday.
During peak season/festive periods, delivery may take longer time. You are advised to place order at least 2 weeks in advance before festive periods such as Hari Raya, Chinese New Year, Deepavali, etc to avoid any late shipment.
If there is nobody qualified to receive the products at the agreed time, logistic will leave the parcel at your main entrance or leave a notification of attempted delivery and you will need to contact CS customer services to re-schedule delivery. In the event CS does not receive any re-schedule confirmation from you within two (2) days from the original delivery date, your order will be cancelled automatically and such cancellation will subject to cancellation processing fee under the section “Order Cancellation” hereto.
Whilst CS will try the best to deliver all your orders in accordance to the scheduled time, CS will not be liable if it fails to do so in part or in full due to any reason whatsoever, or any unforeseen circumstances which beyond CS control.
If there are any changes in the delivery address/contact details after the order has been confirmed, CS will not be liable if the order cannot be reached to the delivery address.
Any form of re-schedule is subject to additional charges, including but not limited to any requests from you of changing delivery date, time and/or delivery address.
For On-demand delivery, the surcharge is subject to the shipping fee from the logistic company at the time of the booked timeslot.
No changes can be made to an order once the order is confirmed. If you would like to place additional order prior to the delivery of your previous order, kindly contact our customer service at email@example.com and check if CS can combine your orders, approved combine orders may subject to additional charges.
CS highly encourage all customers to take a photo of the delivery box/parcel upon receiving just in case if there is a need to request for return.
CS offer a 3-day return policy, as such, you may request for a return within 3 calendar day upon receiving your item.
To request for a return, you can contact CS at firstname.lastname@example.org. Items return to CS without first requesting a return will not be accepted.
All requests will only be processed after CS has received and subject always to the compliance of the followings:-
- The duly filled up return form;
- Order / Invoice Number assigned by CS Online upon order made;
- item shall be in the same condition that you received, unworn or unused, with tags, and in its original packaging;
- Photos of the relevant item(s) and the free gift/accessories contained in the delivery box/parcel; and
- Photos of the delivery box/parcel
You shall ensure the quality of the photos to be clear and CS shall have the right to request for further photos in the event CS is not able to open the photos or the photos are not clear.
CS will review each requests on a case to case basis and, in CS sole discretion to determine whether such request is approved.
In the case where return request is approved, you are required to return the item to CS Warehouse Address as specified below within three (3) calendar days from the date the request has been accepted and confirmed by CS. Proof of shipment shall be email to email@example.com along with the case number assigned by CS.
CS Warehouse Address: Pasaraya CS Cheras (Damai Perdana) HQ, Loading Bay, No. 1&3, Jalan Damai Perdana 6/1E, Taman Damai Perdana, Bandar Damai Perdana, 56000 Cheras, Kuala Lumpur.
In the event you failed to return the item within the above timeline, the request will be automatically cancelled.
All return item received by CS at CS Warehouse Address must be in its original condition (new, sealed condition, tag and labels intact (if any), unworn, unwashed and unaltered). You shall ensure all the complimentary item such as free gifts/accessories that deliver with the item must be returned together.
All return item which do not meet the abovementioned criteria will be strictly declined.
You should bear your own cost for returning the item unless otherwise agreed by CS.
Certain types of items cannot be returned, it will be stated in the product description. Please contact CS if you have questions or concerns about your specific item. CS cannot accept returns on sale items, gift cards, free gifts, perishable items (eg.: vegetables, fruits, seafood, poultry and etc.).
Change of mind is not applicable for return and refund.
Damages and issues
Please inspect your order upon reception and contact CS immediately if the item is defective, damaged or if you receive the wrong item so that CS can evaluate the issue.
Refunds are handle on a case-to-case basis and shall strictly be handled by CS only via firstname.lastname@example.org.
Refunds will only be processed for a returned item if it is a valid and approved return in accordance to the criteria from the above section “Return”.
CS will notify you once CS received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. The number of days for the refund process is vary according to the respective bank processing time. You may contact the relevant bank for more information.
You may cancel the order at no charge only if the order has not been processed. You may contact CS at email@example.com and any cancellation shall subject to CS sole discretion.
A cancellation charge of RM 10, RM30 and RM50 will be imposed for standard delivery, on-demand delivery (normal customer) and on-demand delivery (business customer) respectively.
You can make payment using credit/debit card, e-wallet, and direct FPX transfer from your bank or any method as displayed on CS Online.
CS do not accept cash as payment for any order made through website.
All payments are in Malaysian Ringgit (RM) only.
Your personal data may be disclosed to any relevant party that CS may deem fit for the purpose contained herein, including but not limited to your account registration at CS Online, processing and delivery of our services to you and or any transaction in relation to CS Online, to receive promotion and or offers from CS, or where it is as required by law.
You agree to keep your password confidential and use only your User ID and password when logging in, ensure that you log out from your account at the end of each session on the site, immediately notify CS of any unauthorised use of your Account, User ID and/or password, and ensure that your Account information is accurate and up-to-date. You are fully responsible for all activities that occur under your User ID and Account even if such activities or uses were not done by you. CS will not be liable for any loss or damage arising from unauthorised use of your Account, User ID and/or Password or your failure to comply with this section.
Efforts will be made to ensure that any personal data provided by you to CS is kept up-to-date and is protected, however, CS shall not in any event be liable to you against any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction of your personal data.
You may withdraw your consent for the collection, use and/or disclosure of your personal data in CS procession or under CS control by sending an official request to firstname.lastname@example.org. Please note that your withdrawal of consent may mean that CS will not be able to continue to provide you the access to CS Online and CS may need to terminate your existing account and/or contract (if any). CS may cease to process your Personal Data within a reasonable period upon receiving your written notice pertaining to the withdrawal of the consent.
Although CS Online aims to offer you the best service possible, CS makes no promise that the services at CS Online will meet your requirements. CS cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it by email at email@example.com and CS will attempt to correct the fault as soon as reasonable.
Your access to CS Online may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. CS will attempt to restore the service as soon as it reasonably can.
Your access to or use of the services at CS Online is at your own risk. Without limiting the foregoing, to the full extend as permitted by law, CS disclaims all warranties and guarantees of any kind either express or implied, of merchantability of fitness for a particular purpose. CS makes no representation or warranty that the access to CS Online and or the use of the service thereto will :
- be timely, uninterrupted or error free or operate in combination with any other hardware, software, system or data;
- meet your requirement or expectation;
- be free from errors or that defects will be corrected;
- be free of viruses or other harmful components; or
- be entirely secure or that the information you share with CS will be secure.
No advise or information, whether oral or written, obtained from CS or through CS Online will create any warranty not expressly made herein.
To the full extent allowed by applicable law, you agree that CS will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to CS Online and services therein.
CS shall not liable for any consequential, indirect or special damages or loss of whatever descriptions. To the extent that CS is liable in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Product or any other breach of CS’s obligations hereunder, such liability shall not in any event exceed an amount equivalent to the price of the Product(s).
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia and any disputes will be resolved exclusively only by the Courts of Malaysia.
